WITNESS THIS AGREEMENT this day ___________, by and between, Willowgait Farm, LLC, and ____________________(print clearly)referred to as rider or parent of minor rider. The undersigned acknowledges there are inherent risks associated with equine activities such as described below, and hereby expressly assumes all risks associated with participating in such activities. The inherent risks include, but are not limited to the propensity of equines (horses and ponies) to behave in such ways, such as: bucking, shying, running, biting, kicking, stumbling, rearing, falling, or stepping on, that may result in injury, harm or death to persons on or around them: the unpredictability of equines reaction to such things as, sudden movements sounds, unfamiliar objects, persons or animals, certain hazards such as; surface and subsurface conditions, collisions with other animals; the limited availability of emergency medical care; and the potential of the participant to act in a negligent manner that may contribute to injury to the participant or others, such as failing to maintain control over the animal or not acting within such participants ability.
Rider or parent of minor rider acknowledges that horses, by their very nature are unpredictable and subject to animal whim. Parent of rider or rider assumes all risks in connection therewith, and waives any claims for any injury or loss arising there from. Rider agrees to abide by the manager’s rules and regulations which may be posted or available from time to time. Rider or parent of rider further acknowledges that the behavior of any animal is contingent to some extent upon the ability of the rider. A fair disclosure of the rider’s abilities has been made to the manager of Willowgait Farm, LLC.
Under North Carolina Law, an equine activity sponsor or equine professional is not liable for an injury or death of a participant in equine activities resulting exclusively from the inherent risks of equine activities. Chapter 99E of the North Carolina General Statutes. Rider or parent of rider agrees to hold harmless, indemnify and defend Manager against and hold harmless from, any and all claims demands, causes of action, damages, judgments, orders, costs or expenses, including attorney fees whether incurred or not, which may in any way arise from or be in any way connected with a riders use of or presence upon the property of Manager and the facilities located thereon.
